Terms of Service for MAD Mobile App

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the MAD Mobile App (“Miniature Agnostic Duels,” “the App”) provided by ROTN Development Studios (“we,” “us,” or “our”), including the game rules, factions, cards, artwork, music, gameplay sheets, and counters included with the App.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

You must be at least 13 years old to use the App. If you are under the age of legal majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, for your personal, non-commercial entertainment purposes.

This license is provided to you through the Apple App Store or Google Play, and your use of the App may also be subject to the applicable store's terms and conditions.

3. Acceptable Use

You agree that you will not: copy, modify, or create derivative works of the App or its content except as permitted by law; distribute, rent, lease, lend, sell, sublicense, or otherwise make the App or its content available to others; reverse engineer, decompile, or disassemble the App except where such restriction is prohibited by applicable law; remove, alter, or obscure any copyright, trademark, or other proprietary notices; or use the App for any unlawful purpose or in any way that could damage, disable, or impair the App or interfere with other users.

The App is a companion to a physical tabletop system that uses miniatures provided by the players. We are not affiliated with, endorsed by, or sponsored by the manufacturers of any third-party miniatures, games, or systems that players may use alongside the App.

4. Purchases and Paid Content

The App may be offered for a one-time purchase price or may contain optional in-app purchases. All purchases are processed through the Apple App Store or Google Play, and payment terms, refunds, and billing disputes for purchases are handled by the applicable store under its own policies.

Purchased content and features remain subject to these Terms. We reserve the right to modify, update, or discontinue portions of the App's content as the App evolves.

5. Intellectual Property

The App, including the Miniature Agnostic Duels game system, rules, factions, cards, artwork, text, music, graphics, logos, and related content, is owned by ROTN Development Studios and is protected by copyright, trademark, and other intellectual property laws.

Miniatures, models, and other materials that players provide from their own collections remain the property of their respective owners. No affiliation with or endorsement of Miniature Agnostic Duels by those owners is claimed or implied.

6. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROTN DEVELOPMENT STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID FOR THE APP OR, IF THE APP WAS PROVIDED WITHOUT CHARGE, THE GREATER OF THAT AMOUNT AND THE MINIMUM AMOUNT PERMITTED BY APPLICABLE LAW.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

8. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, if you violate these Terms or if we discontinue the App or a portion of it.

Upon termination, the license granted to you under these Terms ends, and you must stop using the App. Sections that by their nature should survive termination shall survive, including intellectual property, disclaimers, and limitations of liability.

9. Changes to These Terms

We may update these Terms as the App evolves or as legal, regulatory, or platform requirements change. When changes are made, the “Last Updated” date at the top of these Terms will be revised.

Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the United States and the state in which ROTN Development Studios is located, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App shall be resolved in the courts of competent jurisdiction in that location, except where applicable law provides otherwise.
